Medica is a practice management software designed to help medical professionals organize and manage their practices. It is NOT:

  • A substitute for professional medical judgment
  • Medical advice or diagnostic tool
  • A replacement for proper medical training
  • A telemedicine platform (at this time)

2. Professional Responsibility

Medical professionals using Medica remain fully responsible for:

  • All medical diagnoses and treatment decisions
  • Maintaining their professional licenses and credentials
  • Compliance with applicable medical standards and regulations
  • Accuracy of medical information entered into the system
  • Patient care and safety

3. Data Accuracy

While we implement safeguards to maintain data integrity:

  • Users are responsible for ensuring data accuracy
  • We cannot guarantee 100% error-free operation
  • Users should verify critical information before making medical decisions
  • We recommend maintaining backup records as per medical best practices

4. Service Availability

Medica strives for high availability, but:

  • We do not guarantee 100% uptime
  • Scheduled maintenance may cause temporary unavailability
  • Internet connectivity issues may affect access
  • Emergency situations may require immediate service interruption

Do NOT rely solely on Medica for emergency situations. Always have backup procedures.

5. Regulatory Compliance

While Medica is designed to support compliance with:

  • HIPAA regulations
  • NOM-024-SSA3-2012 (Mexican medical records)
  • Mexican data protection laws

Users remain responsible for ensuring their own compliance with all applicable laws and regulations.

6. Third-Party Services

Medica integrates with third-party services (Stripe). We are not responsible for:

  • Third-party service outages or failures
  • Changes to third-party terms or pricing
  • Third-party security breaches

7. No Warranty

Medica is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Fitness for a particular purpose
  • Non-infringement
  • Merchantability
  • Uninterrupted or error-free operation

8. Limitation of Liability

To the maximum extent permitted by law, SEPREMEX and Medica shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data, profits, or business opportunities
  • Medical malpractice or patient harm
  • Damages exceeding the amount paid for the subscription

9. Professional Liability Insurance

Medical professionals are strongly advised to maintain appropriate professional liability insurance. Medica does not provide such coverage.

10. Regional Limitations

Medica is designed for the Mexican healthcare market. Features may not be suitable for other jurisdictions. Users outside Mexico use the service at their own risk.

11. Changes to Software

We reserve the right to modify, suspend, or discontinue any feature at any time without notice. We will make reasonable efforts to communicate significant changes.

12. User Indemnification

Users agree to indemnify and hold harmless SEPREMEX from any claims arising from:

  • Misuse of the Service
  • Violation of these terms
  • Medical malpractice or negligence
  • Violation of applicable laws

13. Emergency Situations

In case of medical emergencies, call 911 or your local emergency number immediately. Do NOT rely on Medica for emergency communications.

14. Acceptance

By using Medica, you acknowledge that you have read, understood, and agree to this disclaimer.
